1. WEBSITE OWNERSHIP

In accordance with Article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (hereinafter, "LSSI"), we inform you that the website https://plataformaflinket.es/ (hereinafter, the "Website" or the "Portal") is operated by Plataforma FLINKET S.L. (hereinafter, "FLINKET" or "the Platform"), with Tax ID B16792558, registered with the Barcelona Commercial Registry on 5 August 2021, Volume 47987, Page 132, Sheet 568436, Entry 1. With Tax ID Number B16792558, domiciled at Calle Velázquez, 46, 5 Derecha, 28001 Madrid, Spain.

2. USE OF THE PORTAL. PLEASE READ THIS DOCUMENT CAREFULLY.

This document constitutes an agreement from which legal obligations arise for you.

These FLINKET Terms and Conditions of Use are binding and govern the Terms of Use and use of FLINKET.

Access to FLINKET grants the status of user to whoever uses it (hereinafter, the "User") and implies full and complete acceptance of these Terms and Conditions, as well as FLINKET's Privacy Policy. The User declares to have read, understood and fully accepted these Terms of Use.

The User is not authorised to use the Platform if (a) they are a minor, have not reached the legal working age and/or lack the legal capacity to enter into contracts, or (b) they have been prohibited by a judicial or administrative authority from accessing and/or using this type of service in their jurisdiction, place of residence or the location from which they access the Platform.

Access to the Website is free of charge, except for the connection costs through the telecommunications network provided by the access provider contracted by the User. FLINKET reserves the right to make modifications and updates to the Website and its content, configuration and presentation, including this Legal Notice, at any time and without prior notice, and we therefore recommend reading it before each access to and browsing of the Portal.

Any User is strictly prohibited from using the Platform and/or any of the Platform's content for purposes or effects that are or may be unlawful, prohibited, harmful to the rights and interests of third parties, as well as from carrying out any action that damages or may damage, disable, overload or impair the Platform and/or causes unauthorised damage or alterations of any kind to the Platform, its content, or other Users. In particular, by way of illustration and without limitation, the User may not:

Remove, circumvent or manipulate the "copyright" and other identifying data of the rights of their holders incorporated into the Portal's content, as well as the technical protection devices or any information mechanisms that such content may include.
Perform any act aimed at damaging, disabling or overloading the Platform's Website, or that would in any way prevent its normal use and operation.
Deceive or defraud FLINKET or other Users, or impersonate another User or person, or use another User's name.
Make improper use of our Services or submit false reports of abuse or misconduct.
Upload or transmit (or attempt to upload or transmit) viruses or any other malware that interferes or may interfere with any User's use and enjoyment of the Platform.
Infringe FLINKET's Industrial and Intellectual Property rights, including, among others, rights over databases, software (source code and object code), interfaces and trademarks (whether registered or not).

In accordance with the above, FLINKET reserves the right to deny access to and use of the Platform and other services whenever the User makes use contrary to these Terms and Conditions. Ultimately, where necessary, FLINKET also reserves the right to take legal action whenever it deems appropriate.

3. DESCRIPTION OF FLINKET SERVICES

FLINKET is an online technology solution aimed at the management and digital support of distribution processes for financial and insurance products, acting exclusively as a technology provider (hereinafter, the "Services").

The content included on the Website does not in any way constitute the provision of legal, tax or private insurance mediation advisory services. The User acknowledges that the information provided is insufficient for decision-making of any nature and therefore should not be relied upon without obtaining appropriate professional advice.

4. ACCESS

To access FLINKET for the first time, the User must (i) accept the Cookie Policy, and (ii) accept these General Terms and Conditions and the Privacy Policy.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

The intellectual property rights over the arrangement of the Website's content, its graphic design (look & feel), the distinctive signs (trademarks and trade names) as well as the various elements that make up the Portal (texts, graphics, photographs, videos, etc.) belong to FLINKET, or it holds the right to use and exploit them, and as such they constitute works protected by current intellectual and industrial property legislation. The use of the Website by the User in no way implies the transfer of any intellectual and/or industrial property right over the Portal, its content and/or FLINKET's distinctive signs. To this end, by means of this Legal Notice, except in those cases where legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Website, its content and/or FLINKET's distinctive signs. The reproduction of elements or content of the Website for profit or commercial purposes is expressly and strictly prohibited.

6. LIMITATION OF LIABILITY

The User acknowledges and accepts that the use of the Website is at all times at their own risk and responsibility, and therefore FLINKET shall not be held liable for any misuse or improper use of the Portal. To this end, FLINKET shall only be liable for damages that the User may suffer from the use of the Website when such damages are covered by applicable legislation.

In particular, FLINKET shall not be liable for:

The content of sites linked through links included within the Website. In this regard, the terms set out in section 7 of this Legal Notice shall apply.
Damages of any kind caused to the User's computer equipment by viruses, worms, trojans or any other harmful element.
Damages of any kind caused to the User resulting from failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the Website's service.

7. LINKS

The Website may include technical linking devices (links) that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, FLINKET acts as an intermediary service provider in accordance with Article 17 of the LSSI, and shall only be liable for the content and services provided on the Linked Sites to the extent that it has effective knowledge of their unlawfulness and has not deactivated the link with due diligence. Should the User consider that a Linked Site contains unlawful or inappropriate content, please notify FLINKET at social@FLINKET.es. Under no circumstances shall this notification entail an obligation to remove the corresponding link.

The existence of Linked Sites in no way implies that FLINKET has effective or any other type of knowledge of their services and content in the event of unlawfulness, nor that it necessarily maintains agreements with those responsible for or owners of the Linked Sites. Nor does the existence of such links imply any recommendation, promotion, identification or endorsement by FLINKET of the statements, content or services provided through the Linked Sites. Consequently, FLINKET shall not be held liable for the content of the Linked Sites, nor for their terms of use and privacy policies, the User being solely responsible for verifying and accepting them each time they access and use them.

The User and, in general, any natural or legal person intending to establish a link from their page or site to the Portal must obtain prior written authorisation from FLINKET. The establishment of such a link does not in any case imply the existence of a relationship between FLINKET and the owner or holder of the site or page on which it is placed, nor the acceptance or approval by FLINKET of its content or services.

In any case, FLINKET reserves the right to prohibit or disable links to the Website at any time, especially in cases of unlawfulness of the activity or content of the page or site that includes the link.

8. JURISDICTION AND APPLICABLE LAW

These Terms and Conditions shall be governed by and construed in accordance with the common law provisions of Spanish legislation.

For any matters arising from the interpretation, compliance and enforcement of these Terms and Conditions, the User and FLINKET submit to the competent courts and tribunals in accordance with applicable legislation.

In the event that any of the provisions contained in this Legal Notice is declared null and void, it shall be removed or replaced. In any case, such declaration of nullity shall not affect the validity of the remaining provisions set out in this Legal Notice.
